Smoking hookah is relaxing and especially fun with friends. Thanks to the many fruity-sweet tobacco flavors and the cooled smoke, enjoying a hookah has little in common with the ordinary smoking of a cigarette. No wonder, then, that hookahs are especially tempting to young people. Still, everyone should be clear on one thing: smoking hookah is only allowed from the age of 18.

According to §10 of the German Youth Protection Act (Jugendschutzgesetz):

Selling tobacco to anyone under 18? Prohibited.
Applies in shops, at vending machines and in mail order.
Anyone who does it anyway is committing a criminal offence.

A little extra: The law refers to the tobacco, not to the hookah itself. That means: you are allowed to own a hookah, but not anything that lets you actually smoke it while you are under 18.

Important when travelling: If you want to go on holiday in another country, find out about the local laws beforehand. Ignorance will not protect you from punishment, and that can get expensive. There are also countries where you are allowed to smoke hookah earlier than in Germany.

In Germany, smoking hookah, whether with or without nicotine, is only allowed from the age of 18 under §10 of the German Youth Protection Act.

Are minors allowed to own a hookah?

Yes, minors are allowed to own a hookah. However, products that make smoking possible are prohibited. These include, for example, tobacco, substitute products such as vaping pastes, vaping stones or cellulose-based tobacco substitutes, as well as e-liquids and e-cigarettes.

Does the age restriction also apply to e-shishas and nicotine-free products?

Yes, nicotine-free hookah products, e-shishas and e-cigarettes are also subject to the same Youth Protection Act and are only allowed from the age of 18.

What happens if you break the law?

Selling tobacco and nicotine products to anyone under 18 is a punishable offence and can result in high fines or further legal consequences.
