How old do you have to be to smoke hookah?

Smoking hookah is relaxing and especially fun with friends. Thanks to the many fruity-sweet tobacco flavors and the cooled smoke, enjoying a hookah has little in common with the ordinary smoking of a cigarette. No wonder, then, that hookahs are especially tempting to young people. Still, everyone should be clear on one thing: smoking hookah is only allowed from the age of 18.

Hookah has long been more than a passing trend and is part of an evening with friends for a lot of people. Plenty of half-truths are still going round about the rules. Can I go into a hookah bar at 16? Does an e-shisha without nicotine count too? And what if my parents allow it at home? The answers are in the law, and that is exactly where we looked for this article instead of in some forum.

When are you allowed to smoke hookah? The short answer

From 18. In Germany, smoking hookah is only allowed from the age of 18, no matter whether nicotine is involved or not. This is regulated in §10 of the German Youth Protection Act (Jugendschutzgesetz). Anyone younger gets no hookah tobacco in a shop or online, and in a licensed venue nobody is allowed to let them smoke either. Turning 18 is the only line that counts. Your older brother’s ID or a nicotine-free version does not change that.

What the law says: smoking hookah is only allowed from the age of 18

The relevant passage is §10 of the German Youth Protection Act. It refers to tobacco products, other nicotine-containing products and their containers, and it leaves little room for interpretation:

• Selling to children and young people? Prohibited. In shops, in licensed venues and anywhere else in public.
• Smoking and consumption in public? Must not be permitted to minors, not even by the operator of a bar.
• Vending machines? Only with a technical age check or constant supervision, so that minors cannot take anything out.
• Mail order? Tobacco products must neither be offered to minors nor sold to them.

Which hookah products fall under the rule?

When it comes to youth protection, many people only think of the classic tin of tobacco. The law covers a lot more than that.

Hookah tobacco and other tobacco products

Every hookah tobacco is included, whether classic with nicotine or as a nicotine-free version. And the containers are covered too, which means the tin itself.

E-cigarettes, e-shishas and liquids

The legislator explicitly closed this gap. §10 also applies to nicotine-free products in which a liquid is vaporised by a heating element and the aerosol is inhaled through the mouth. That puts e-cigarettes, e-shishas and e-shisha liquids on the same footing as tobacco. “But it is nicotine-free” is not an argument, the law does not know that exception.

Vaping stones, vaping pastes and other tobacco alternatives

Tobacco-free alternatives without nicotine, meaning vaping stones, vaping pastes or cellulose-based tobacco substitutes, are not explicitly named in §10. We and most other retailers still only sell them to customers over 18. The reason is simple: they are smoked in a hookah bowl just like tobacco, and at its core youth protection is still there to make sure people start no earlier than adulthood, and ideally later than that.

In short: anything that is smoked or vaped. So to the question “Are minors allowed to smoke hookah?” there is only one answer: a clear no.

Are minors allowed to own a hookah?

The pipe as such is not a tobacco product, and neither are the bowl, the hose or the vase. If you get one as a present, you are allowed to keep it. It simply stays empty, because there is no legal way for you to get the tobacco before you turn 18.

Only allowed from 18: how the age check works when you buy

To keep the rule from being just words on paper, the buyer’s age has to be checked at the point of purchase. How that looks depends on where you buy.

In shops and at vending machines

In a specialist shop the age check runs via your ID. Anyone without one leaves without tobacco, even if they obviously look old enough. Vending machines in public spaces need a technical age check, usually via a bank card or an identity card.

In online shops and mail order

Online the same applies, only digitally. The shop builds an age verification step into the checkout, and on delivery there is usually a visual age check at the door as well. A parcel containing tobacco products must not simply be left with a neighbour or dropped in the hallway. For you that means: have your ID ready, otherwise the shipment goes back.

Can I go into a hookah bar at 16?

We get this question a lot, and it has two parts. The first one is clear: you are not allowed to smoke there at 16. §10 names licensed venues explicitly, so the operator must not let you smoke.

The second part is about getting in, and it is less consistent. For licensed venues in general the Youth Protection Act says that young people aged 16 and over may stay until midnight without a parent or guardian, while under-16s only with a guardian or between 5 a.m. and 11 p.m. for a meal. Many hookah bars, however, are run as smoking-only venues, and what is allowed there is regulated by each federal state in its own non-smoker protection law. In practice most operators therefore only let adults in. When in doubt, call ahead instead of standing in front of the door.

And at home? What parents should know

§10 talks about shops, licensed venues and the public sphere. Your own home is not part of that, which means parents decide within their parental responsibility. What does not change: nobody is allowed to hand the products to minors. No retailer, no parents, no older friends. So a session at home is not a loophole.

And just because something is not explicitly forbidden, it is still not a good idea. The sweet flavors make hookah look more harmless than it is.

Why the age limit exists in the first place

There are two points behind the age limit.

The first one is nicotine. It has a high potential for addiction, and with young people in particular the habit sets in quickly. We took a closer look at how much of it is actually in a session in Is there nicotine in hookah tobacco?

The second one is the charcoal. Around 90 percent of the carbon monoxide in the smoke comes from the burning charcoal and not from the tobacco. Since a hookah session is rarely over after five minutes, quite a bit adds up. There is more on that in How harmful is hookah?

Smoking hookah abroad

So a look at the rules of your destination belongs in your travel preparation. Some countries draw the line at 21, others ban water pipes in public entirely. Do not assume it will be roughly the same as it is here.
