Why hookah tobacco is left out of every sale
The entire shop is discounted, but your hookah tobacco stays at its regular price? That is not because retailers suddenly become stingy when tobacco enters the basket. Tobacco products in Germany have a legally regulated retail price.
The manufacturer or importer sets that price. You can find it on the tax stamp attached to the pack. For the retailer, it is not a suggested price that can be changed whenever a promotion starts.
In short: Accessories can go on sale. A retailer cannot simply reduce the price shown on the tax stamp of taxed hookah tobacco.
Who sets the price of hookah tobacco?
Under Section 3 of the German Tobacco Tax Act, the manufacturer or importer determines the retail price. The tax stamp corresponds to the pack size and pack price. Price and taxation are therefore linked before the tin even reaches a retailer's shelf.
That is why an identical tin normally costs the same across German shops. Unlike with a hookah, bowl or hose, the retailer does not calculate an individual promotional price.
Which hookah tobacco discounts are prohibited?
Section 26 of the German Tobacco Tax Act is clear: When tobacco is supplied to consumers, the retailer may not undercut the pack price or retail price printed on the tax stamp. The retailer may not grant a normal discount either.
This covers more than a crossed-out sale price. The law also includes rebates based on turnover. Retailers may not add free items to a tobacco sale or link the supply of tobacco to the sale of other goods.
- Voucher codes: A general shop code must exclude tobacco if it would reduce the price of the tobacco product.
- Cashback and bonus schemes: Refunding part of the purchase afterwards can also amount to a discount on the fixed price.
- Free accessories and bundles: Tobacco cannot be used to unlock a free item or a linked price advantage.
This is why the terms of many promotions say that tobacco products are excluded. The code may still work for eligible accessories, but not for the tin of tobacco in your basket.
Can a shop charge more for hookah tobacco?
The price is not freely adjustable upwards either. Section 28 of the German Tobacco Tax Act prohibits selling above the stated retail price. The price on the tax stamp is the key reference.

Can the price of hookah tobacco still change?
Yes. A fixed retail price does not mean that a variety must cost the same forever. Manufacturers or importers can set a different retail price for new packs and use the matching tax stamps. Changes in production costs, pack size or tax burden can all play a part.

Important:Section 27 of the German Tobacco Tax Act lists narrow exceptions, including certain clearance sales or goods that have lost value. Official approval is required. A normal summer sale does not fall into that category.
How can you still compare tobacco prices sensibly?
A voucher code will not help with the tobacco itself. A closer look still makes sense. Compare the price per gram, check the pack size and avoid buying a large tin blindly when you have never tried the flavour. A cheap mistake is still a mistake.
